MAISON LES ENERVES — Terms & Conditions of Sale

1. About Us

These terms and conditions of sale are concluded between Maison les énervés, a company with a share capital of €5,000.00, registered office located in Hong Kong, registered with the Hong Kong Trade and Companies Registry under number 2894543, operating the website www.maisonlesenerves.com ("we", "us"), and any natural or legal person making a purchase via the website ("the Buyer", "you").

2. Scope & Acceptance

These terms define the contractual relationship between Maison les énervés and the Buyer for any purchase made through www.maisonlesenerves.com. Placing an order implies full acceptance of these terms, which the Buyer acknowledges having read prior to ordering.

The Buyer declares that purchases made on the site are not related to a professional activity, are limited to strictly personal use, and that they have full legal capacity to commit under these terms.

We reserve the right to modify these terms at any time to comply with new regulations or improve the use of our site. The terms applicable to an order are those in force on the date the order is placed.

3. Products

The products offered are those displayed on www.maisonlesenerves.com, while stocks last. We reserve the right to change the product range at any time.

Each product is presented with a description of its main characteristics. Product photographs are as faithful as possible but are provided for guidance only. Minor differences between the photograph and the received product (colour rendering, embroidery placement, etc.) do not constitute defects.

Products are intended for buyers residing in countries that fully allow the import of these products into their territory.

4. Prices

Prices shown on the site are in Euros (€) or USD. As the company is based in Hong Kong, no VAT is charged. We reserve the right to modify prices at any time; however, the price displayed on the day of the order is the only one applicable to the Buyer.

Prices do not include:

• Delivery costs, invoiced in addition according to the order total, and shown at checkout before payment.
• Customs and import duties, which may be applied by your country upon delivery (see Section 7).

5. Orders & Payment

To place an order, the Buyer adds products to the basket, verifies or enters the delivery address, reviews shipping costs and carrier, and selects a payment method.

Before confirming, the Buyer must review all information and accept these terms by ticking the corresponding box. Payment is processed through a secure interface. Once payment is accepted, the order is registered and the contract is definitively formed. An order confirmation is sent by email.

Payment is irrevocable, except in the event of proven fraudulent use of the Buyer's card. In that case, the cardholder must dispute the debit in writing with their bank within the timeframe provided by their card agreement.

Confirmation of an order constitutes proof of the transaction and acceptance of these terms.

Retention of title: Maison les énervés retains full ownership of the products sold until full payment of the price, including costs and taxes.

6. Order Cancellation

You may cancel your order within 24 hours of purchase, provided it has not yet been shipped. Email contact@maisonlesenerves.com with:

• Order number
• Name the order was placed with
• Email address the order was placed with

We reserve the right to cancel and refund any order suspected of fraud or abuse of these terms.

7. Delivery

We ship worldwide to the address indicated on the order form. A tracking number is provided for every shipped order. Delivery is made without signature; please ensure you are home or reachable to arrange delivery.

Delivery times are indicative only and additional delays may apply.

If your delivery address needs to be modified after ordering, contact customer service as soon as possible.

Transport risks: Transport risks are borne by the Buyer from the moment the items leave our premises. The Buyer must check the parcel in the presence of the delivery agent. Any damage due to transport must be reported to the carrier within three (3) days of delivery.

Customs & import duties: We cannot guarantee the absence of customs and import duties upon delivery. These fees are outside our control and must be paid by the recipient of the package. Customs duties paid are not refundable by us.

8. Returns & Exchanges

8.1 Return window & options

You may return eligible items within 14 days of receipt of your parcel for an exchange or store credit. Store credit is issued for the value of the returned item(s) and never expires.

To initiate a return, email contact@maisonlesenerves.com with:

• Order number
• Name the order was placed with
• Email address the order was placed with

Returns sent without prior authorisation may face processing delays or be rejected.

8.2 Return conditions

To be eligible, the item must be:

• Unworn, unwashed, and undamaged (fitting to check size and comfort is acceptable)
• In its original packaging, with all price tags and brand labels attached
• Accompanied by the original invoice as proof of purchase

We reserve the right to charge a cleaning/administration fee or refuse the return if these conditions are not met. Items returned after the 14-day window will be rejected. If your return is rejected, you will be notified by email.

Non-returnable items: sale items (including purchases made with a discount code), hats, and jewellery.

8.3 Return costs

• If the return is due to your choice (wrong size ordered, change of mind, item not to your liking): return shipping costs, duties and taxes are at your expense. We are not responsible for loss, theft or damage of return parcels; we recommend a tracked service.
• If we sent you the wrong item or a damaged/defective product: return shipping costs are at our expense.

8.4 Return address

8.5 Processing

Once we receive your return, the item goes through inspection. If it meets all criteria, we will issue your store credit for the order amount (minus any return costs we have covered) within 14 business days.

8.6 Exchanges

For a different size, colour or style: return your item following the process above, then purchase the new piece with your store credit.

9. Faulty, Defective or Incorrect Items

If you receive a damaged, defective or incorrect item, contact us within 7 days of delivery at contact@maisonlesenerves.com with:

• Order number
• Name the order was placed with
• Email address the order was placed with
• A photograph illustrating the damage

Minor differences between product photographs and the received product do not count as defects.

Legal warranty: All products benefit from the applicable legal guarantees of conformity and against hidden defects. In the event of non-conformity, the product may be returned for exchange or refund, at our expense.

10. Liability

In the distance selling process, Maison les énervés is bound only by an obligation of means. We cannot be held liable for damage resulting from the use of the Internet network, such as loss of data, intrusion, virus, break in service, or other involuntary problems.

11. Intellectual Property

All elements of the website www.maisonlesenerves.com (photos, logos, visuals, texts, embroidery designs) are and remain the exclusive intellectual property of Maison les énervés. No reproduction, exploitation or use of any element, even partial, is authorised for any purpose whatsoever.

12. Personal Data

Maison les énervés is committed to preserving the confidentiality of the information provided by the Buyer. Personal data is collected and processed in accordance with applicable data protection regulations, including the EU General Data Protection Regulation (GDPR) for buyers located in the European Union.

You have the right to access, rectify, delete and port your personal data, and to object to or restrict its
